Former Everton Director Loses Sanctions Challenge Over Putin Ties

Sarvar Ismailov, a former director at Everton FC, has lost his High Court bid to overturn sanctions imposed due to his billionaire uncle Alisher Usmanov's links to Vladimir Putin. The Foreign Office defended its decision, arguing that familial relations can be a legitimate basis for sanctions.

Sarvar Ismailov, who previously served as a director at Everton Football Club, has lost his High Court challenge against the UK Foreign Office's decision to maintain sanctions against him. The sanctions were initially imposed in 2022 following Russia's invasion of Ukraine, stemming from his familial connection to his uncle, Uzbek-Russian oligarch Alisher Usmanov, who has known ties to Russian President Vladimir Putin.

Ismailov had sought a review of the decision in 2023, and while the specific wording of his designation under sanction laws was amended in 2024, the sanctions themselves remained in place. His legal team argued that it was "outrageously unfair" for him to be sanctioned "simply for being his uncle's nephew."

The Foreign Office's Stance

The Foreign Office robustly defended its position in court, with its barristers asserting that sanctioning individuals based on familial relations "serves several rational and legitimate purposes." Mr. Justice Pushpinder Saini ultimately dismissed Ismailov's claim, concluding that the Foreign Office was "uniquely well-placed to assess whether sanctions decisions would achieve their intended purpose" and that their decision was not "irrational."

The judge's 46-page ruling accepted that it was "reasonable to assume" Ismailov could "exert pressure" on his uncle. He also found that the decision to continue sanctioning Ismailov was "plainly connected" with the broader objectives of the sanctions scheme, which include demonstrating "negative consequences" for those associated with individuals linked to Russia.

Impact on Sanctions Regime

Justice Saini clarified that the objective was not for Ismailov's designation alone to end the conflict, but rather for it to contribute to the stated objective as part of the overall sanctions regime. He stated, "The claimant's designation, and others like him who are 'associated with' [Mr. Usmanov], makes an important contribution to the overall cumulative impact of sanctions and enhances pressure on Russia in respect of its actions in Ukraine." This ruling underscores the government's approach to leverage a wide range of connections to exert pressure on the Russian government.

Ismailov's Background at Everton

Born in Uzbekistan, Sarvar Ismailov joined Everton in 2019 and was appointed to the club's board in the summer of 2021. However, he stepped down from this role and other positions at the club in November of the same year after being charged with a criminal offence, which was subsequently dropped.

His barrister, Hugo Keith KC, highlighted in written submissions that Ismailov moved to the UK at the age of 13 and has never resided in Russia as an adult. Keith added that Ismailov possesses no political profile or connections within Russia, nor does he have any relationship or access to Putin or other Russian government officials. The defence counsel also stressed the absence of evidence that Ismailov had ever supported the Russian government or the war in Ukraine, describing the sanctioning of his client as "utterly purposeless" and the decision as "plainly irrational" and "capricious."
